Welcome to GUJMART, a Software as a Service (SaaS) platform developed and maintained by JG IT Solution. By accessing or using our platform, you agree to comply with these Terms & Conditions.

1. Acceptance of Terms

By creating an account, subscribing to a plan, or using any GUJMART services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

2. Account Registration

  • You must provide accurate and complete registration details.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities performed under your account.
  • You must immediately notify us of any unauthorized use of your account.

3. Subscription Plans & Payments

  • All subscription fees must be paid in advance.
  • Setup charges are non-refundable.
  • Subscription fees are non-refundable after activation.
  • Services may be suspended if renewal payment is not received before the due date.
  • Prices may change for future subscriptions or renewals without prior notice.

4. Website Content

Customers are solely responsible for all content uploaded or published on their websites including products, pricing, images, videos, documents, and other business information.

You must not upload or publish:

  • Illegal, fraudulent or misleading content.
  • Copyrighted material without proper authorization.
  • Viruses, malware or harmful scripts.
  • Adult, abusive, hateful or offensive content.
  • Content that violates applicable laws or third-party rights.

5. Custom Domain & Hosting

  • Customers may connect their own domain with eligible plans.
  • Domain registration and renewal charges are separate unless specifically included.
  • Customers are responsible for renewing their domains before expiry.
  • DNS propagation time depends on domain providers and cannot be guaranteed.
  • Hosting resources must not be misused or abused.

6. Data Ownership

Customers retain ownership of their website content and business data. GUJMART and JG IT Solution only provide the software platform and hosting infrastructure and do not claim ownership of customer content.

7. Data Backup

We may perform periodic backups; however, customers are strongly advised to maintain their own backups. JG IT Solution shall not be responsible for data loss caused by accidental deletion, cyber attacks, hardware failures, third-party services, or customer negligence.

8. Third-Party Services

GUJMART may integrate with third-party services including payment gateways, SMS gateways, WhatsApp services, shipping providers, Google services, Meta/Facebook services, and email providers.

These services are governed by their own terms and policies, and GUJMART is not responsible for their availability or functionality.

9. Service Availability

We strive to maintain maximum uptime; however, temporary interruptions may occur due to server maintenance, upgrades, hosting issues, internet outages, security updates or unforeseen technical problems.

10. Technical Support

Technical support includes:

  • Platform-related issues.
  • Bug fixes.
  • General technical guidance.

Technical support does not include:

  • Custom development.
  • Graphic design.
  • SEO services.
  • Third-party software issues.
  • Content creation or data entry.

11. Account Suspension & Termination

We reserve the right to suspend or permanently terminate accounts without prior notice if users:

  • Violate these Terms & Conditions.
  • Engage in illegal or fraudulent activities.
  • Fail to pay subscription fees.
  • Misuse server resources.
  • Attempt unauthorized access to the platform.

12. Intellectual Property

The GUJMART platform, software, source code, branding, logo, interface, features, and technology remain the exclusive intellectual property of JG IT Solution.

Users may not:

  • Copy or redistribute the software.
  • Reverse engineer the platform.
  • Modify or resell the software.
  • Use GUJMART branding without written permission.

13. Refund Policy

  • Setup charges are non-refundable.
  • Subscription fees are non-refundable after service activation.
  • No refunds will be issued for partially used subscription periods.

14. Limitation of Liability

JG IT Solution shall not be liable for any indirect, incidental, special, or consequential damages including business interruption, data loss, lost profits, customer disputes, or third-party service failures arising from the use of GUJMART.

15. Privacy

Customer information is handled securely. We do not sell customer data to third parties. Personal information is processed only for providing and improving our services.

16. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Continued use of the platform after changes are published constitutes acceptance of the updated Terms.

17. Force Majeure

JG IT Solution shall not be responsible for delays or failures caused by circumstances beyond reasonable control including natural disasters, government actions, cyber attacks, internet failures, power outages, war, or other force majeure events.

18. Governing Law

These Terms & Conditions shall be governed by the laws of India. Any legal disputes shall be subject to the jurisdiction of the courts located in Rajkot, Gujarat, India.
